For almost a year, Lamwell lawyers represented a Client in a dispute with a supplier of agricultural commodities.
The dispute was submitted to the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry.
During the three-day arbitration hearing, witnesses from both sides were examined and comprehensive arguments were provided by lawyers.
The dispute was complicated by the fact that the parties had radically opposing views of the contractual provisions and assessed the facts differently. As a result, a counterclaim was filed by our Client in this case.
A dispute also arose over the application of the Vienna Convention on the International Sale of Goods, in light of the presence of representative offices of both companies in Kyiv, although the parties themselves are registered outside of Ukraine. The decision in the case satisfied the interests of our Client. We are glad to have once again protected the interests of our Client in a complex dispute.
