We represented the claimant in a dispute with an Italian manufacturer of industrial equipment.
The dispute arose due to shortcomings in the quality of two machines for the production of bottles delivered by the respondent.
Despite the application of Swedish substantive law to the contract, which significantly limited the broad application of contractual penalties, our lawyers prepared, filed and substantiated before the arbitral tribunal the position of the purchaser with regard to the recovery of a significant amount of damages from the Italian equipment manufacturer.
As a result of exchanges of written submissions by the parties as well as negotiations for the amicable settlement of the dispute, the Italian side agreed to voluntarily pay the purchaser a significant amount of monetary compensation for losses incurred due to the unsuitable quality of the delivered machines. On these grounds, the arbitration proceedings were terminated.
